This policy complies with Brazilian Federal Law No. 8.078/1990 — Consumer Defense Code (CDC), in particular the articles applicable to purchases made outside the commercial establishment (online purchases) and to product defect scenarios.
1. Right of withdrawal (online purchases)
Under art. 49 of the CDC, the consumer may cancel the purchase, without providing a reason, within 7 (seven) calendar days from the date the product is received.
- The withdrawal request must be sent by email to joministudio@gmail.com with the order number and the reason (the latter is optional).
- The product must be in its original packaging, with no signs of use, with all accessories and protective materials.
- Return shipping costs are on us — we provide a Correios postage code or schedule a pickup.
- Per the sole paragraph of art. 49, any amounts paid will be returned immediately, monetarily updated, after the product is received and inspected.
- For credit-card installment purchases, the refund follows the operator's schedule; for PIX/debit, the refund is processed within 10 business days.
2. Defective product (art. 18 and 26 of the CDC)
Resin collectible models are durable goods. If the item presents a quality flaw or apparent defect, the customer has 90 (ninety) days from delivery to file a complaint (art. 26, II).
- Communication by email to joministudio@gmail.com, with:
- Order number;
- Clear photos of the product and packaging;
- Description of the observed problem.
- Per art. 18, §1, we have up to 30 days to remedy the defect. If not remedied, the consumer may choose between:
- Replacement of the product with another of the same kind in perfect condition;
- Immediate refund of the amount paid, monetarily updated;
- Proportional price reduction.
- Shipping for defect-related exchanges is on us.
3. Damage in transit
- Whenever possible, open the packaging in the presence of the courier. If visible damage is verified, refuse the delivery and register the occurrence with the carrier.
- If damage is noticed after delivery, contact us within 7 calendar days with photos of the product and the outer packaging.
- After review, we'll reship at no cost, replace with an equivalent item, or issue a full refund.
4. Wrong or mismatched product
- If the item received is different from what was purchased (model, scale, livery, described color), contact us within 30 days of delivery.
- We will exchange for the correct item, with pickup and reshipping at no cost, or a full refund if you prefer.
5. Items not covered by the right of withdrawal
On-demand models (custom orders, parts produced upon specific request) are made-to-order goods and do not fall under art. 49 of the CDC, per the consolidated understanding of the Brazilian Superior Court of Justice (STJ). For those items:
- Before production, a digital preview can be requested for approval.
- After printing has started, modifications may incur additional cost.
- Defects normally follow art. 18 and art. 26 of the CDC (item 2 of this policy).
6. Procedure and timelines
- Customer requests an exchange/return by email within the applicable timeframe.
- Confirmation and posting instructions (or scheduled pickup) are sent within 2 business days.
- After the product is received and inspected, the refund or reshipping is processed within 10 business days.
- For credit-card refunds, the chargeback follows the operator's schedule (usually one or two billing cycles).
7. Inherent product characteristics
Resin-printed models with handcrafted finishing show small variations in color, texture, gloss, and weight inherent to the process. These variations do not constitute a defect and are consistent with art. 18 of the CDC, which considers a defect to be unsuitability for the intended purpose or relevant divergence from the listing.
