Terms of Use

These Terms of Use govern the relationship between JOMINI STUDIO ("we") and you ("user" or "customer") when accessing and using the site, registering an account, and purchasing resin-printed collectible models. By using our services, you declare that you have read, understood, and agreed to all conditions described here, as well as to our Privacy Policy.

If you do not agree with any provision of these terms, please do not use the site.

1. Registration and account

  • Registration is free and intended for those over 18 or for minors duly assisted by their legal guardians.
  • You are responsible for the truthfulness, accuracy, and timeliness of the information you provide.
  • The password is personal and non-transferable. You are responsible for all activity carried out on your account.
  • In the event of unauthorized use of your account, notify us immediately.
  • We reserve the right to suspend or cancel accounts that violate these terms, contain false information, or involve fraud.

2. Products, prices, and availability

  • The products are resin-printed collectible models with handcrafted finishing. Small variations in color, texture, and weight are inherent to the process and do not constitute a defect.
  • Images are illustrative. Painting and finishing details may vary.
  • Prices are expressed in Brazilian Reais (R$) and include applicable taxes. Shipping cost is calculated separately at checkout.
  • Product availability may run out at any time. We will confirm availability before approving the order.
  • Obvious price errors (e.g., a clearly unfeasible amount) do not generate an obligation to fulfill; in that case, the order may be canceled with full refund of the amount paid.

3. Order and payment

  • The order is only considered accepted after payment confirmation by the provider — InfinitePay (orders within Brazil) or Stripe (international orders).
  • Available payment methods: credit/debit card and PIX (Brazil, via InfinitePay); credit/debit card and other international methods enabled by the gateway (international, via Stripe).
  • We do not store card data. All processing is performed in the payment provider's environment (InfinitePay or Stripe).
  • We may cancel or not approve orders in cases of suspected fraud, inconsistent data, or payment failure.

4. Shipping, lead times, and delivery

  • The delivery period begins counting after payment approval and any production lead time (when on-demand), not from the order date.
  • The lead time shown at checkout is estimated based on the ZIP code and the carrier. Holidays, strikes, or unforeseen events may cause delays.
  • It is the customer's responsibility to provide a complete and correct address. Returns due to invalid addresses may incur additional reshipping costs.
  • If the carrier loses a package, we will file a complaint with the operator and, after confirmation of the loss, will reship or refund.

5. Right of withdrawal

Under art. 49 of the Consumer Defense Code (Federal Law No. 8.078/1990), you may cancel the purchase within 7 (seven) calendar days from receipt of the product, with no need to justify. In that case:

  • The product must be returned in its original packaging, with no signs of use, with all accessories.
  • Return shipping costs will be on us, via a posting code we provide.
  • After inspection, the refund will be issued by the same payment method within 10 business days (card) or via PIX (when applicable).

6. Exchange for defect

  • Products with apparent defect must be reported within 30 days of receipt (art. 26 of the CDC).
  • Request the exchange by email at joministudio@gmail.com with photos of the item and packaging, order number, and description of the problem.
  • After review, we will repair, replace with an equivalent item, or refund the amount.
  • Fragile resin-printed pieces may suffer damage in transit; we pack them with adequate protection, but improper handling by the carrier is covered by the exchange policy.

7. Customized and on-demand pieces

  • Customized models, on-demand pieces, or items printed at the customer's specific request do not fall under the right of withdrawal, since they are produced to individual specifications (CDC art. 49 does not apply to made-to-order goods).
  • Before production, approval of a digital preview may be requested. Changes after printing has started may incur additional costs.
  • The production lead time will be informed in the quote and added to the shipping time.

8. Intellectual property

  • All site content — brand, logo, texts, images, product photos, source code, and 3D files — belongs to JOMINI STUDIO or is licensed to it, protected by copyright and industrial property laws.
  • Reproduction, redistribution, reverse engineering, or commercial use without express authorization is prohibited.
  • Purchasing a product does not transfer rights over the 3D model nor authorize reproduction of the item for resale.

9. Prohibited conduct

By using the site, you agree not to:

  • Provide false, misleading, or third-party information without authorization.
  • Perform reverse engineering, mass scraping, or unauthorized automated access.
  • Attempt to bypass security, authentication, or payment mechanisms.
  • Use the site for unlawful purposes or to violate third-party rights.
  • Engage in any form of fraud, improper chargebacks, or misuse of coupons.

Irregular conduct may result in order cancellation, account suspension, and civil and criminal liability.

10. Limitation of liability

  • We make our best efforts to keep the site available, but we do not guarantee uninterrupted operation; there may be maintenance interruptions.
  • We are not liable for damages arising from acts of God, force majeure, internet failures, unavailability of third-party services (payment gateway, carriers), or improper use of the product by the customer.
  • Our liability is limited, at most, to the amount actually paid for the product purchased.

11. Coupons and promotions

  • Discount coupons have validity periods, limited quantities, and specific terms of use.
  • They are not cumulative with other promotions, except where stated otherwise.
  • They may be canceled in case of misuse or suspected fraud.

12. Changes to the Terms

These terms may be updated at any time to reflect legal, operational, or product offer changes. The "last updated" date at the top indicates the current version. Substantial changes will be communicated to registered customers by email. Continued use of the site after notification constitutes acceptance of the new conditions.

13. Applicable law and venue

These terms are governed by the laws of the Federative Republic of Brazil. The venue of Fortaleza – CE is hereby elected to settle any disputes, without prejudice to the consumer's right to file actions at his/her own domicile, per art. 101, I of the CDC.
